The author uses the recent decision to extend frequency rights as an opportunity to examine the discretionary parameters within this EU-law-influenced legal framework. It becomes apparent that the 'predetermination' of the discretionary decision in favor of a reallocation, as assumed by the Federal Administrative Court (BVerwG) in 2011, must continue to apply despite amendments to the Telecommunications Act (TKG).
